To the editor:
The Florida Supreme Court has now asked for dozens more trial judges. This is the judicial version of the "throw-money-at-it approach" that governments typically use to address perceived societal problems. It is fundamentally wrong.
Courts exist for the convenience of the litigants. However, private arbitration and mediation should be encouraged. Governmental courts should be a desperate last resort, because they are rarely the first-and-best thing to do. Justice-by-agreement is better. This is "self-inflicted justice." with no governmental action at all.
As the platform of the Libertarian Party of Florida states: "... III Courts … 1. Private adjudication of disputes. We support and encourage private adjudication of disputes by mutually acceptable arbitrators or mediators prior to utilizing the public court system. Current law unnecessarily constrains private adjudication as a first resort …".
